We cannot guarantee that any products that have been included at some point on the Site will be available at all times. We reserve the right to stop marketing a product at any time.

We are a company that deals with the online sale of abstract paintings. 

YOUR PERSONAL DATA PERSONAL CHARACTER

ELIGIBILITY 

In order to legally place an order on our website, you must (1) be over 18 years of age and/or have full legal capacity; (2) agree to this Agreement; and (3) provide us with true, complete, and up-to-date identity and contact information. 

Sale to minors. The site does not sell products to minors. If you are under 18, please use a parent/guardian to place the order on your behalf. or to authorize the placement of an order.  

RULES REGARDING THE USE OF THE SITE 

Rules. By accessing, visiting, placing an order or carrying out any other activity on our website, you undertake to comply with the following rules: 

1. You will use this website exclusively for making legitimate orders or for information; 

2. You will not make any false or fraudulent order, otherwise we reserve the right to cancel the order and inform the competent authorities or go to court to recover any damages caused; 

3. You will provide real, accurate, complete and up-to-date information; 

4. You will respect the intellectual property rights regarding any element found on this site.  

5. You will not carry out any action that could bring any kind of damage to our site, otherwise we reserve the right to go to court to recover any damages caused.  

6. You will not appropriate / use the images, products, texts, icons, logo of the site or any other element on this site. 

Consequences. We reserve the right to block access to any user who violates the above rules, to cancel orders, to notify the competent authorities for administrative / criminal liability of any antisocial acts and to go to court for the full recovery of any damages caused, present or future, including lost benefits and court costs (including lawyers' fees). 

CONCLUSION OF THE CONTRACT 

Date of conclusion of the contract. The contract between you and us ends when your order is expressly accepted by us and you will receive an email confirming delivery.  

Protection. If we do not accept your order, but you have been withdrawn, we will refund such amounts as soon as possible.  

The decision is ours. We reserve the right to decide, unilaterally and without stating the reason, whether or not to conclude a sales contract. We will have no liability to you. if we refuse to comply with an order. Ownership of the products will transfer to you only after you have made payment of all amounts due for the products, including delivery costs.  

PRODUCT AVAILABILITY 

We cannot guarantee that products found at some point on the site will be available for purchase at all times. We will have no liability to you. if a product is no longer found on the site. Although we will try to keep product availability information up to date on the site in real time, we cannot guarantee that this information will be up to date at all times. All orders will depend on the existence of products in stock.   

Guarantees. Insofar as the products are unavailable but you have already placed your order, we will inform you of the unavailability of these products and recommend similar products of equal or close value that can be ordered. If you do not want to order similar products recommended by us, we will cancel the order, and to the extent that you have already paid the price of the products, we will proceed to return the money as soon as possible.  

PRODUCT PRICE. PAYMENT. DELIVERY 

The price of the products is displayed in euros on the website and includes value added tax. If there is an error regarding the price displayed on the site, we will notify you as soon as possible, and we will refund you the amount of money paid additionally or request an additional amount of money. If the new price is not satisfactory for you, you do not respond to our request or we cannot contact you, we will cancel your order and refund you as soon as possible the amount paid.  

Product prices may be updated/modified at any time, and such update/change will replace any previous price. Your order Prices will apply to him at the time of actual placing of the order.  

Payment for ordered products can be made as follows: through the "Stripe" interface, made available at the completion or placement of the order.  

For online payment by bank card, the processing of your card data is done through "Stripe" and we will not store any data related to your card. 

If you choose to pay by card, the issuing institution will proceed to validate and authorize the payment. If the transaction is not processed for reasons independent of us (e.g., non-existent funds on the card, expired card), the contract between us will not be concluded and we will have no obligation to deliver the products, but you. You can select a different payment method or try processing your payment with a valid card again.  

No deliveries are made on Saturdays and Sundays. Please note that in certain situations, especially during holidays or Black Friday, delivery time may be extended, which may result from the congestion of courier companies or other reasons independent of us. The delay in delivery will not be due to our actions or inactions, but to an event external to us, in which case you agree not to claim our liability under any circumstances.  

FORCE MAJEURE AND UNFORESEEABLE CIRCUMSTANCES 

We will not be held liable for any delays or failures in the performance of our services, if a force majeure or fortuitous event occurs. Force majeure includes, but is not limited to, changes in laws or regulations, embargoes, wars, terrorist acts, riots, fires, earthquakes, nuclear accidents, floods, strikes, epidemics, pandemics, weather conditions, and acts of hackers or internet service providers.  

RIGHT OF WITHDRAWAL 

According to GEO 34/2014, if you are a consumer (natural person) you have the right to withdraw from the contract, without any specific reason, within 14 days from the day when you or a third party mandated by you, other than the carrier, came into physical possession of the products. INTELLECTUAL 

The entire content of the site is the intellectual property of N. RUSU ALEXANDRU NICOLAE PFA. The Site may be used by third parties only for information and/or placing orders. 

Site users do not have the right to download, modify partially or fully the site, reproduce partially and / or fully the site, copy, distribute, sell or exploit the site in any other manner contrary to the interests of N. RUSU ALEXANDRU NICOLAE PFA Company, regardless of whether there is a commercial purpose or not. 

Any content (including, but not limited to databases, graphics, trademarks, legal content) are the intellectual property of N. RUSU ALEXANDRU NICOLAE PFA. The entire site is protected by Law nr. 8/1996 on copyright and related rights, and for any infringement of intellectual property, we reserve the right to notify the competent courts for full recovery of the damage, as well as to file a criminal complaint with the judicial bodies for bringing the perpetrator to criminal liability.  

FINAL CLAUSES  

These Terms constitute the entire agreement between you and us with respect to the subject matter of any Agreement and supersede any other agreement, prior oral or written agreement between you and us.  

This Agreement is binding. You may not transfer, assign, encumber or otherwise alienate this Agreement or any of your rights or obligations arising therefrom without our prior written consent. We may transfer, assign, strike, subcontract or otherwise dispose of a Contract or any of our rights or obligations under the Agreement.   

This Agreement, as well as any use of the site, will be governed by Romanian law. Any dispute between us will be submitted for settlement to the Romanian courts.
